Storm damage is stressful. It can be made worse by difficult insurance adjustors. Storm chasers knocking on your door isn’t fun either. If you are in North Carolina and have a storm damage insurance claim to your property, there are laws that protect you. Filing a claim shouldn’t be difficult or confusing. There are time limits your insurance company has to respond to any NC storm damage insurance claim.
Do I Have a Time Limit to File a Storm Damage Insurance Claim?
Although you don’t legally have a time limit by law to file your NC storm damage insurance claim, your policy may have limits. The state only requires that you give “immediate written notice” after a loss. However, when you wait, the evidence can deteriorate. In short, the longer you wait to file your claim, the higher the likelihood that clear evidence of storm damage could look more like wear and tear and aging of your roofing system. If you suspect you might have storm damage, call your roofer. They will be able to confirm your suspicions and recommend you call your insurance company.
How Long Does My Insurance Company Have to Respond to My Claim?
North Carolina does a good job of taking care of policy holders by setting reasonable and firm deadlines for your insurance company and you after filing a claim.
- Insurance companies have 30 days to respond that they received your claim.
- You have 60 days from filing notice to provide proof of loss. This can be a written evaluation from an independent insurance adjustor or your roofing company. In most cases it will be from their adjustor.
- Your insurance company then has 60 days to provide a response. This can range from denying your claim to investigating it to providing a check for settlement, repair or some other agreed upon means of restoration.
What Can I Do if My Insurance Company Denies My Claim?
Assuming you’re working with an experienced roofing company, ask them to meet with an insurance adjustor from your insurance company at your home. The roofing company and adjustor can meet and discuss why they are at odds over the state of your roof. Hopefully at that point, the adjustor will see what your roofer sees and approve your claim.
